. 1. PRICE AND PAYMENT
The price of the product/s is that advertised on Herbal Health Sciences "(HHS)"'s website (the
"Site") from time to time. The price and other information displayed on this Site may be changed
or updated without notice.
1.2 All prices are inclusive of taxes. The additional charges for postage and packaging are
described on the ite. International delivery may be subject to additional delivery charges.
Herbal Health Sciences are not liable for any taxes, duties, seizure or any other costs
whatsoever incurred during international delivery.
1.3 Payment will be made by debit or credit card. Orders can not be processed unless these
details are provided on the electronic order form.
2. DELIVERY Herbal Health Sciences will endeavour to deliver the product/s to any destination
within [4] weeks of receipt of your order.
3. RETURN OF PRODUCT/S You may return the product/s to Herbal Health Sciences within [30] days of
receiving the product/s provided that the products in question have not been opened or damaged in
any way. You will be liable for the cost of postage and packaging.
4 LIABILITY
4.1 Herbal Health Sciences makes no representations or warranties, express or implied, regarding
the product/s and all representations, conditions, warranties, terms and conditions whether
express or implied by statute, common law or otherwise are excluded to the fullest extent
permitted by law.
4.2 Nothing in this agreement will exclude or limit the liability of either party for death or
personal injury caused by that party's negligence.
4.3 Subject to clause 4.2, Herbal Health Sciences liability in contract, tort or otherwise
arising out of or in connection with the Product/s in respect of each event or series of
connected events will be limited to the greater of the price of the product/s ordered or [two
hundred and fifty pounds].
4.4 In no event will Herbal Health Sciences be liable to you for any indirect, special,
incidental, punitive or consequential losses or damages (including third party claims) or loss of
profits, revenue goodwill or anticipated savings or for any financial loss whatsoever (save to
the extent caused by fraudulent misrepresentation or deceit) suffered by you or any third party
howsoever caused (including any loss or damage suffered by you as a result of an action brought
by a third party) arising in relation to the product/s or any action taken in reliance on the
product/s (including any information contained thereon), regardless of whether any such loss or
damage would arise in the ordinary course of events or otherwise, or is reasonably foreseeable or
is otherwise in the contemplation of the parties. No liability is excluded to the extent such
liability may not be excluded or limited by law.
5. GENERAL
5.1 Herbal Health Sciences is entitled to refuse an order placed by you. If Herbal Health
Sciences exercise this right it will notify you (by post, e-mail fax or telephone) within two
weeks of receipt of your order and return any monies already provided as soon as practicable. For
the avoidance of doubt, the agreement is concluded on the earlier of delivery of the product/s or
the expiration of the notice period (set out above).
5.2 Time is not of the essence in this agreement.
5.3 Damages to or loss of the product/s in transit are not the responsibility of .Herbal Health
Sciences
5.4 These terms and conditions represent the entire agreement between the parties.
5.5 Herbal Health Sciences may modify these terms and conditions at any time by an on-screen
message to this web-page and the modification will take effect from the date it is first made
available on this page.
5.5 If any part of this agreement is held to be invalid or unenforceable, the validity or
enforceability of the remainder will not be affected.
5.7 The parties do not intend any of these clauses to be enforceable pursuant to the Contracts
(Rights of Third Parties) Act 1999.
5.8 Herbal Health Sciences will not be responsible for any loss, damage or otherwise as a direct
or indirect result of the failure to perform or delay in performing obligations, nor will there
be a breach of the contract as a result of the occurrence of any cause whatsoever beyond its
control including without limitation acts of god, war, hostilities, riot, fire, explosion,
accident, flood, sabotage, lack of adequate fuel, power, raw materials, containers,
transportation or labour strike, lock out or injunction, compliance with government laws,
regulations or orders, breakage or failure of machinery or apparatus, or any other cause whether
or not of a class or kind enumerated which affects performance of the agreement arising from or
attributable to acts, events, non- happenings, commissions or accident beyond the reasonable
control of Herbal Health Sciences
5.9 The product/s are not intended for sale or distribution to, or use by, any person or entity
in any jurisdiction or country where such sales, distribution or use would be contrary to law or
regulation or which would subject Herbal Health Sciences to any additional registration
requirement within such jurisdiction or country.
